That second shoe drop is virtually built in to the AR drafted abuse laws which nominally deal with return of the animals at the end of a case for a finding of no abuse but don’t even do that for any other bad acting on the government/AR side. The statutes are generally completely silent on what happens to all other penalties imposed (like care costs) if the case goes south for the government. That’s what opens the door for this mess.
Now, under general legal principles, he should win but, in the meantime, he has to deal with more litigation, more stress, more legal bills, more defamation,...
hsus is a low down dirty bunch!

why in the world any court would entertain the notion of charging a man who’s property was illegally raided and whose animals were illegally seized is beyond me. we are expected the believe the animal ‘rescue’ group spent amost $2500 per dog while they were in their care? did not not also take in donations for the care of these animals? did they not also receive adoption fees?
since when are American courts in the practice of paying the thieves to steal from you?
